Lake Lanier at lowest level since historic drought

Written By Kom Limpulnam on Senin, 26 November 2012 | 23.17

GAINESVILLE, Ga. -- Authorities say Lake Lanier is now at its lowest level since March 2009 after dropping two feet in two weeks.

Officials say the lake is now at 1,058 feet above sea level, or 13 feet below full pool.

The Times of Gainesville reports that the last time Lake Lanier hit such a low mark was during the 2007-09 drought, when the lake was at 1,050.79 feet.

The U.S. Army Corps of Engineers predicts that Lanier could drop to 1,055.2 feet by Dec. 21.

The agency says there's been very little rain anywhere in the Apalachicola-Chattahoochee-Flint River basin in recent days. The basin includes portions of Georgia, Florida and Alabama.

Autopsy to show if Valdosta State student was killed

VALDOSTA, Ga. -- Investigators are awaiting autopsy results before making a final determination about the death of a Valdosta State University freshman.

Authorities already have said they believe homicide is behind the death of 17-year-old Jasmine Benjamin, a Valdosta State freshman from Lawrenceville.

But a commander with the Valdosta Police Department, Brian Childress, said police can't call the case a murder until they get a final autopsy report.

Officials say it could be several weeks before that report is available.

The aspiring nursing student was found unresponsive on a couch in a study room. Authorities initially told Benjamin's parents she died of natural causes.

5 ways to maximize Cyber Monday savings

ATLANTA -- Cyber Monday arrived on Cyber Sunday this year!  Most major retailers began their online promotions on Sunday and will carry them through midnight Monday.

RELATED | Top Cyber Monday deals and where to find more

Before you hit the Checkout button, here are my top 5 Ways to Save on Cyber Monday.

1 - Compare Prices.  This season, many toy prices are within pennies of each other at Walmart, Target, Amazon and Toys "R" Us this season, at least in many cases. Just to make sure you're getting the best price, compare prices at PriceGrabber.com or even through a simple Google Search.Priceblink.com will also compare prices and look for coupon codes for you while you are shopping online.

2 - Use Loyalty Cards. I love the Target Red Card, because it is a debit card that allows me to get free shipping on nearly all Target.com purchases, plus gets me a 5 percent discount on purchases. That often tips the scale in favor of Target over Walmart when it comes to price!

3 - Get Cash Back.  If you start your search through Swagbucks.com you will earn Swagbucks, which can be redeemed for gift cards at Amazon and other retailers.  Swagbucks, Ebates and several other sites offer rebates that vary on any given day. For example, Ebates was recently offering a 5 percent cash back bonus for shopping at Nordstrom.com.

RELATED | Earn prizes for searching the Internet?

4 - Buy Gift Cards for Free Gas. Kroger has a promotion that offers shoppers quadruple fuel reward points for purchasing a variety of other retail  store gift cards (most are free) at Kroger gift card Kiosks. For example, if you buy a $200 Target gift card at Kroger, you will earn 800 Fuel Reward points. You can apply the points for discounts of up to $2 per gallon on gasoline, so a fillup of a 20 gallon tank would get you a $40 discount on gas.   You must use fuel points the during the calendar month after you buy them. Keep in mind, Visa and Amex Gift cards usually have a processing fee. Most retail cards do not.

5 - Look for Free Return Shipping.  Many retailers will offer free shipping, but returns can be expensive.  Nordstrom.com, 6pm.com, Piperlime.com, Zappos.com, and Shoebuy.com all offer free return shipping. Target and Walmart give customers the option of returning many items bought online either in the store or by printing a free preprinted label.  Other retailers like Victoria's Secret and Loehmann's offer free shipping and allow shoppers to return items in stores to avoid paying return shipping.

And by the way, running up credit card debt is harmful to your budget but running up credit card rewards is very helpful!  If you can pay off your cards every month and carry a zero balance, why not take advantage of free perks like miles, cash back and hotel perks?

Colts cheerleaders shave heads to support cancer-stricken coach

Indianapolis Colts cheerleaders from left to right Crystal Ann and Megan M have their heads during a game against the Buffalo Bills at Lucas Oil Stadium. (US Presswire)

INDIANAPOLIS (USA Today) -- Indianapolis Colts fans far exceeded the $10,000 in donations needed for a member of the team's cheerleading squad to shave her head. So, on Sunday, Megan M. sat in a chair and had her hair cut in front of a sold out crowd in Indianapolis as a show of support with cancer-stricken coach Chuck Pagano.

PHOTOS | Cheerleades shave heads to support coach

The second-year cheerleader agreed earlier this month to shave her head if fans donated more than $10,000 for cancer research. The support was greater than expected, as donations topped $22,000.

Megan went through with the cut during the fourth quarter of the Indianapolis win over the Buffalo Bills. Another cheerleader, Crystal B., joined Megan in getting her head shaved. Blue, the mascot, started the sheering but handed the clippers to a more experienced stylist later.

"I've just had personal experiences with people who have had cancer," Megan told Daniel Miller of TV station WISH. "I've had mentors and family members and volunteer at Riley and met little girls who have lost their hair and beat cancer multiple times. Just seeing struggles they went through and how they could overcome that and still have confidence and fight this fight without their hair - they are really my inspiration for doing this."

Lithonia Walmart death under investigation

LITHONIA, Ga.-- DeKalb County police are investigating the death of a man after three employees wrestled him to the ground outside of a Lithonia Walmart.

Around 1:30 a.m. Sunday, the middle-aged man left the Walmart on Fairington Road. Two Walmart employees and a security guard followed him out to the parking lot. They wrestled him to the ground, and were holding him for police. When DeKalb County police arrived, the man was not responsive. He was taken to DeKalb Medical Hillandale where he was pronounced dead. An autopsy will determine how he died.

A Walmart spokesman said they're cooperating with the police investigation. In a statement, Kayla Whaling with Walmart corporate communications said, "Our associates are trained that the safety of our customers and our associates is our first priority. No amount of merchandise is worth someone's life. Associates are trained to disengage from situations that would put themselves or others at risk."

The two Walmart employees have been suspended with pay during the investigation. The security guard involved is no longer with the company.

Improbably, Georgia in mix for national title

Written By Kom Limpulnam on Senin, 19 November 2012 | 23.17

ATHENS, Ga. -- Alabama was supposed to be the best team in the country. Then Oregon and Kansas State got all the hype. Now it's Notre Dame looking down at everyone else.

Plodding along quietly, barely noticed, is one other team that has a prime spot in the national championship race.

The Georgia Bulldogs.

Coach Mark Richt's squad moved up to No. 3 in The Associated Press poll Sunday and is expected to hold the same spot when the BCS standings are released. That means there are only three teams that control their own destiny: top-ranked Notre Dame, second-ranked Alabama - and Georgia.

The Bulldogs need to beat Georgia Tech in the regular-season finale, then Alabama in the Southeastern Conference championship game to earn a shot at the big prize in Miami.

Injured officer and wife prepare to come home

Holly Springs Police Officer Shane Ladner and his wife Meg.

HOLLY SPRINGS, Ga. -- Family and friends are hopeful Holly Springs Police Officer Shane Ladner and his wife Meg will be flying home Monday after being involved in a deadly parade accident.

Shane suffered back injuries. Doctors had to amputate Meg's leg.

RELATED | Send the Ladners a note of support

11Alive's Duffie Dixon sat down with Meg's mother and friends of the couple who say they could be air ambulanced to Metro Atlanta as soon as Monday.

Meg's best friend, Susan Greene, has been in touch with Shane daily to find out how things are progressing.

"Meg is stabilized so as soon as they can coordinate an air ambulance flight to Atlanta Medical Center we can get them home.  We just want them here so we can comfort them and help them," said Greene.

The Ladners were in Midland, Texas for an all expenses paid hunting trip for wounded heroes.  Shane served in Somalia and Iraq and received two purple hearts. Thursday night, while riding in a parade, a train collided with the float they were on. Four veterans were killed.

Meg's mother and several others, including Holly Springs Police Sgt. Brian Cain, were flown to Texas to see Shane and Meg.

"It is very hard on Shane to see Meg in the state she is in. That is his angel.  It is heartwrenching for him.  He just couldn't imagine something like this happening," said Sgt. Cain.

From the moment friends and fellow members of the police department found out about the accident there has been a flurry of activity to help the Ladners.

A Facebook page called "Prayers for Shane and Meg Ladner" has been set up to post the lastest news about the couple.  A fund has been set up through Cherokee Bank in their names.  Shane's buddies are looking at how their house can be renovated to be more accessible for Meg and there's talk about fundraisers.

Help Desk | Home Depot steps up to help the Ladner family

"We don't want them to worry about medical bills and expenses right now.  We want them to focus on recovering and it is going to be a long road," said Greene.

The Ladners married 10 years ago, and friends describe their relationship as one of unconditional love. Both have an inner strength and support eachother.

"Meg was so proud of Shane and his service in the military and his work as a police officer. She was so excited to go to Midland where he was going to be recognized for all of his hard work," said Greene.

As for the accident, Shane has expressed sorrow for the fellow veterans who died and for those injured, including his wife.

"Shane kept saying to me 'I tried to save her, I tried to save her'. I said 'You did save her. You got her off the float.  She's alive,'" said Greene.

Justin Bieber dedicates AMA awards to 'haters'

LOS ANGELES -- America proved its Bieber Fever was strong: The teen singer dominated the American Music Awards on Sunday night.

Bieber's wins included the show's top award, artist of the year. His mom joined him onstage as he collected the trophy, beating out Rihanna, Maroon 5, Katy Perry and Drake.

"I wanted to thank you for always believing in me," Bieber said, looking to his mom.

The 18-year-old also won the honor in 2010. He said it's "hard growing up with everyone watching me" and asked that people continue to believe in him.

Bieber and Nicki Minaj performed together – and separately – at the AMAs, and were both multiple winners.

But another collaboration was the night's most colorful performance: Korean rapper PSY and MC Hammer. Hammer joined the buzzed-about pop star for his viral hit Gangnam Style. PSY rocked traditional "Hammer" pants as they danced to his jam and to Hammer's Too Legit to Quit.

Bieber won favorite pop/rock male artist in the first award handed out at Sunday's show and gave a shout-out to those who didn't think he would last on the music scene.

"I want to say this is for all the haters who thought I was just here for one or two years. I feel like I'm going to be here for a very long time," he said.

He also won favorite pop/rock album for his platinum-selling third album, Believe. He gave a stripped down, acoustic performance of As Long As You Love Me, then transitioned to the dance-heavy Beauty and a Beat, where Minaj joined him onstage, grinding with the teen for a few seconds.

Minaj, who wore three different wigs and four outfits throughout the night, repeated her AMAs wins from last year, picking up trophies for favorite rap/hip-hop artist and album for Pink Friday: Roman Reloaded. She was in an all-white get-up, including fur coat and pink hair when she performed her new song Freedom. The scene was ghostly and snowy, as a choir – also in white – joined her onstage. One background singer stole the performance, belting semi-high notes as Minaj looked on.

As Bieber won his second award, he was kissed on the neck by Jenny McCarthy, who presented the award.

"Wow. I feel violated right now," he said, laughing.

"I did grab his butt," McCarthy said backstage. "I couldn't help it. He was just so delicious. So little. I wanted to tear his head off and eat it."

Bieber's red and black outfit seemed to be the night's theme, as Taylor Swift and Usher wore similar ensembles.

Usher kicked off the three-hour show with green laser lights beaming onstage as he performed a medley of songs, including Numb, Climax and Can't Stop, Won't Stop, which featured a smoky floor and a number of backup dancers, as Usher jammed in all black, with the exception of his red shoes. He won favorite soul/R&B male artist.

Swift won her fifth consecutive award for favorite country female artist.

"This is unreal. I want to thank the fans. You guys are the ones who voted on this," she said.

Swift gave a masquerade-themed performance of the pop song I Knew You Were Trouble. She sang onstage in a light dress while dancers wore mostly black. But then she changed into a red corset and black skirt, matching their dark mood. She even danced and sang on the floor as lights flickered throughout the performance.

Dick Clark, who created the AMAs, was remembered by Ryan Seacrest and an upbeat performance by Stevie Wonder.

"What a producer he was," said Seacrest, as Wonder sang his hits, including My Cherie Amour.

Carly Rae Jepsen, who performed early in the night, won favorite new artist.

"I am floored. Wow," she said, thanking Bieber and his manager, Scooter Braun.

Party girl Ke$ha was glammed up on the red carpet, rocking long, flowy blonde hair and a light pink dress. She switched to her normal attire when she performed her hit single Die Young. It was tribal, with shirtless dancers in skin-tight pants, silver hair and skeleton-painted faces, who also played the drums. Ke$ha was pants-less, rocking knee-high boots and rolling on the floor as she finished up the song.

Minaj and Christina Aguilera were blonde bombshells, too: Minaj's hair was busy and full of volume and she sported a neon strapless gown to accept her first award. Aguilera wore a blonde bob in a purple dress that matched her eyeshadow.

Aguilera performed a medley of material from her new album and joined Pitbull onstage.

Kelly Clarkson also hit the stage, making a nod to her American Idol roots with a number on her dress and three judges looking on as she sang Miss Independent. Then she went into Since U Been Gone, Stronger and Catch My Breath. It's worth noting that Idol judge Randy Jackson introduced Clarkson, the first-ever winner of the show. He also advised people to donate through Red Cross for Superstorm Sandy victims.

Fellow Idol winner Carrie Underwood won best favorite country album and performed, hitting the right notes while singing Two Black Cadillacs. She talked about singing competition shows backstage.

"These people that go on these shows are so talented, you know? And I would love to see if so many of the other artists that are out there today would go back and try out for these shows, because they might get their behinds kicked by some of the contestants," she said.

Luke Bryan won favorite country male artist and Lady Antebellum favorite country group.

American Music Awards nominees were selected based on sales and airplay, and fans chose the winners by voting online. At this award show, even the stars were fans: Pink said on the red carpet that she'd like to collaborate with Lauryn Hill. Cyndi Lauper said her musical playlist includes Pink and Minaj. Boy band The Wanted said they were excited to see PSY and Colbie Caillat wanted to watch No Doubt.

"What makes the American Music Awards special is the fans choose the winning artists," said Chester Bennington of Linkin Park, who won favorite alternative rock artist and performed Burn It Down, as Brandy sang along and Gwen Stefani, Usher and Phillip Phillips bobbed their heads.

David Guetta won the show's first-ever electronic dance music award. Non-televised awards went to Katy Perry for pop/rock female artist, Beyonce for soul/R&B female artist, Adele for adult contemporary artist and Shakira for Latin artist.

Along with Rihanna, Minaj was the top nominee with four nominations.

Georgia Tech heading to ACC Championship Game

CORAL GABLES, Fla. -- Miami is self-imposing a postseason ban for the second straight year in response to a lengthy and ongoing NCAA investigation into the school's compliance practices.

University officials announced the decision Monday morning, shortly before the Hurricanes (6-5) started practice for what now is their season-finale at Duke this weekend.

PHOTOS | Football's ugliest uniforms

Miami's decision effectively ends the ACC's Coastal Division race; Georgia Tech will play Florida State for the ACC crown and an Orange Bowl berth.

By self-imposing another ban, Miami is hoping to lessen the hit of any looming sanctions that could be handed down by the NCAA. It's surely a disappointment for the Hurricanes, since Miami still had a chance to win the Atlantic Coast Conference championship.

The Yellow Jackets (6-5, 5-3 in ACC play) are appearing in their first ACC Championship game since 2009, when they downed Clemson, 39-34 in a victory that had to be later vacated.

The ACC Championship Game is scheduled for Saturday, December 1 at Bank of America Stadium in Charlotte.

Georgia Tech closes its regular season Saturday against number 3-ranked Georgia in Athens.

Georgia, 5 other teams still have shot at BCS title

The Coach's Trophy, awarded annually to the national college football champion (Getty Images)

A look at the six teams with a realistic shot at playing for the BCS title:

No. 1 Notre Dame (11-0)

Case for: Brian Kelly said last week he would go on TV with Oprah Winfrey, if necessary, to politic for a spot in the BCS Championship game. No need. The Irish are unbeaten against a schedule filled with name opponents. College football's most historic program has not won a national championship since 1988, but led by Manti Te'o and a dominant defense, the Fighting Irish are one victory from a perfect regular season.

Case against: While the defense has been great, the offense has been erratic. Redshirt freshman quarterback Everett Golson has improved through the season, but five victories have come by a touchdown or less.

What's left: At Southern Cal, Saturday.

PHOTOS | November cheerleaders

No. 2 Alabama (10-1)

Case for: SEC! SEC! SEC! After a week on the outside looking in, the defending national champion benefited from two upsets. Considered by many to be the nation's best and most complete team - at least until Texas A&M punctured the aura - the Crimson Tide's typically tough defense has been bolstered for most of the season by an offense led by quarterback A.J. McCarron.

Case against: The Tide will be heavily favored to beat woeful Auburn, but the Iron Bowl rivalry shouldn't be written off. Up next would be Georgia in the SEC Championship, where a defense that faltered against LSU and Texas A&M would be tested .

What's left: At Auburn, Saturday; if win, SEC Championship game, Dec. 1.

No. 3 Georgia (10-1)

Case for: The Bulldogs control their destiny. Beat Georgia Tech, then the SEC West winner (probably Alabama). Also, SEC! SEC! SEC! As a one-loss SEC champion, they would play for the BCS title.

Case against: Georgia benefited from a quirk of the SEC schedule, avoiding West division powers Alabama and LSU. The Bulldogs' only significant victory is against Florida, a 35-7 loss to South Carolina left a mark and the combined record of their other SEC opponents is 26-40.

What's left: Vs. Georgia Tech, Saturday; SEC Championship game.

No. 4 Florida (10-1)

Case for: Florida owns victories over LSU, South Carolina and Texas A&M, the latter on the road. Add a victory over Florida State, currently 10th in the BCS standings, and the overall resume would be pretty stout.

Case against: The Gators didn't win their division. But BCS history has proven that's not a disqualifying blemish, especially in the SEC! SEC! SEC! A 17-9 loss to Georgia reflected an offense that has struggled. Beating the Seminoles in Tallahassee should not be counted on.

What's left: At Florida State, Saturday.

No. 5 Oregon (10-1)

Case for: With myriad offensive weapons and Chip Kelly's relentless, frenetic pace, the Ducks are capable of putting together massive piles of points and yards. If he were touting Oregon, Les Miles would note that the Ducks have not lost in regulation.

Case against: They lost in overtime. At home. After being favored by nearly three touchdowns. That's sometimes unforgivable this late in the season. The unstoppable offense was stuffed by Stanford, quenching part of the Ducks' argument for elite status. To get back into the race, Oregon needs help: Losses by at least two of the four higher-ranked teams - and probably by Florida.

What's left: At Oregon State, Saturday; if win, possibly Pac-12 Championship game, Nov. 30 (Stanford must lose to UCLA).

No. 6 Kansas State (10-1)

Case for: Until the loss at Baylor, the Wildcats had dismantled opponents methodically, as befitting Bill Snyder's m.o. The resume includes victories over BCS No. 13 Oklahoma and No. 21 Oklahoma State, as well as West Virginia and Miami. The season finale would include a victory over No. 16 Texas.

Case against: It's one thing to allow Baylor to score. But given the Bears' aversion to defense, how did Kansas State manage only 24 points? If it came down to Kansas State or Oregon for a berth in the BCS title game, voters might recall that in 2010, Bill Snyder canceled a matchup this season with the Ducks.

What's left: vs. Texas, Dec. 1.

Help Desk | Home Depot steps up to help the Ladner family

HOLLY SPRINGS, Ga. -- Holly Springs Police Officer Shane Ladner and his wife Meg were among those on a wounded veterans parade float that was hit by a train in Texas last week. Four people were killed and more than a dozen were hurt, including the Ladners.

When they arrive home in Holly Springs, they will be met by what is fast becoming as traditional as Georgia hospitality -- Georgia generosity.

RELATED | Injured officer and wife prepare to come home

It's a community that cares about its neighbors and those in need. And top corporations are no exception.

It didn't take long for home improvement giant Home Depot to answer the Help Desk's call.

Their involvement with veterans is well known, and when we mentioned that Shane Ladner had served in Iraq, the response was instantaneous.

RELATED | Send the Ladners a note of support

Doctors had to amputate one of Meg Ladner's legs after the crash. When she and her husband come home, one of the first things she will need is a ramp to have easy access in and out of the house.

Home Depot and its well known Volunteer Force will make that happen.

Then, inside house adjustments will have to be made to make everything accessible.

Again, Home Depot will make that happen.

But that's not all.

We plan to meet with the Ladner's as soon as they are settled back in Holly Springs and see what else they may need.

One thing is for sure -- they will need a van, equipped so Meg Ladner has easy access.

The Help Desk has already started work on that one.

With the help of a leading auto dealer in Rome, Ga. that is our first priority.

Deltalina is back in new Delta air safety videos

Written By Kom Limpulnam on Senin, 12 November 2012 | 23.17

Delta flight attendant Katherine Lee, dubbed "Deltalina" by viral video fans, in a new air safety video for the air carrier. (Delta Air Lines)

ATLANTA - Delta Air Lines has a pair of new safety videos that are getting the attention of folks across the internet.

This isn't the first time that the Atlanta-based carrier's air safety videos have caught the attention of the viral video set.

In 2008, red-headed flight attendant Katherine Lee was dubbed "Deltalina" by fans who saw her in an air safety video from Delta that made its way to YouTube.

The new videos strike a tongue-in-cheek tone, while delivering the government-mandated safety instructions about the safety features of the aircraft.

Despite new flight attendants in the primary roles, for Deltalina's fans, she has a cameo in the videos -- with her smile and playful wag of her finger at someone who looks at smoking on board the plane.

Delta's new videos are being rolled out this month on board the carrier's flights.

FOX 5 anchor Amanda Davis arrested for DUI, reckless driving

ATLANTA -- FOX 5 news anchor Amanda Davis was arrested early Sunday for driving under the influence near Piedmont Park.

Atlanta Police Sgt. Gregory Lyon said Davis was arrested at around midnight after an accident on Piedmont Avenue near 14th Street. He said the crash scene suggested Davis was driving northbound in a southbound lane when her green Fiat collided head on with a black Toyota.

"Upon speaking with both drivers, the officer noticed an odor of alcohol emanating from Ms. Davis' person," Sgt. Lyon said in a statement. "He asked her if she had been drinking, to which she did respond in the affirmative."

Lyon said Davis refused to submit to a field sobriety test and the State Administered Chemical Test, but a DUI officer found probable cause to arrest her for impaired driving.

In addition to DUI, Davis was also charged with reckless driving and failure to maintain lane. Her license was confiscated and she was taken to jail, according to Lyon.

School bus involved in 4-car wreck

COVINGTON, Ga. -- A Newton County school bus was involved in a chain reaction collision Monday morning.

The accident happened at around 7:30 a.m. on Highway 212 near Oak Hill Elementary School in Covington.

Georgia State Patrol confirmed a car left the school driveway and pulled in front of the bus. The bus could not stop in time and hit the car.

The bus then moved into the opposite lane and hit another car, which was then rear-ended by a pickup truck.

Newton County Schools spokesperson Sherry Viniard said the driver of the car that cut off the bus was thrown from her vehicle. She was taken to a local hospital in "very serious" condition. Investigators said the woman was a parent who had just dropped off her child at Oak Hill Elementary.

A parent and child in the car that was rear-ended were also taken to the hospital, Viniard said. Their conditions are not yet known.

A witness told 11Alive News the bus was full of Alcovy High School students. Viniard confirmed that 34 students were on the bus. Three were injured and taken to the hospital.

APD officers identified in fatal helicopter crash

Written By Kom Limpulnam on Senin, 05 November 2012 | 23.17

ATLANTA -- Two Atlanta Police officers were killed when an Atlanta Police helicopter crashed near the intersection of Martin Luther King and Hamilton E. Holmes drives on Atlanta's West Side late Saturday.

The Atlanta Police Department identified the officers as Officer Richard J. Halford and Officer Shawn A. Smiley. Officer Halford had served with the APD since 1986. Officer Smiley joined the department in 2010.

In a news conference, Atlanta Police Chief George Turner said the helicopter was involved in a search for a missing 9-year-old boy when the crash happened at about 10:30 p.m.

Police said the boy disappeared at about 7 p.m. and was found shortly after the crash.

His mother said he had run away before. She was griefstricken that the two officers were killed while trying to help find her child.

No one on the ground was reported hurt in the crash, which is under investigation by the National Transportation Safety Board and the Federal Aviation Administration.

Witnesses said the helicopter was flying low and clipped power lines as it crashed to the ground.

Georgia Power said about 1,250 customers lost power as a result. They said they were not able to get to the crash area to handle repairs right away, since authorities were still working in that area as part of their investigation.

Once Georgia Power crews were able to enter the area, they were able to move fairly quickly on repairs, and were able to restore service for most customers by about 2 a.m.

Court to hear arguments in 'Girls Gone Wild' case

ATLANTA -- A federal judge has asked the state's high court to clarify parts of Georgia law in a case involving a woman who was 14 when she exposed her breasts during spring break in Florida to a man with a video camera who later sold the clip for use in a provocative women's video series.

The high court is set to hear arguments in the case Monday.

Lindsey Bullard sued video producers in 2004 after her bare-breasted image appeared in a "Girls Gone Wild" video. Bullard, who's now 26, is seeking damages for the alleged unauthorized use of her image.

A federal judge has said it's unclear under Georgia law whether Bullard has a viable claim. The federal judge has asked the Georgia Supreme Court to answer questions on Georgia law.

Goodell to meet with Deal, Reed about new Falcons stadium

Matt Ryan throws a pass in the second half of Sunday's game against the Oakland Raiders at the Georgia Dome. The Falcons beat the Raiders 23-20. (Daniel Shirey-US PRESSWIRE)

ATLANTA -- NFL Commissioner Roger Goodell says Atlanta needs a new stadium to keep up with other NFL cities and make a serious bid for hosting a Super Bowl.

The commissioner will meet with Governor Nathan Deal, Atlanta Mayor Kasim Reed and other city leaders on Monday to discuss plans for a retractable roof stadium to replace the Georgia Dome.

RELATED | New Falcons stadium: $1.2 billion?

"There are always difficult projects," he told reporters before Sunday's Falcons Cowboys game. "When you're going through a project like this, you have to balance a lot of issues. They're financial. They're also making sure you find a solution that works in the community and works with the team."

The Falcons are seeking partial public funding for the project. If approved, the hotel-motel tax would contribute $300 million to the costs. The Falcons would cover the rest.

The Falcons would also get to keep revenues as operators of the new stadium under current plans.

The plans would also guarantee the Falcons stay in Atlanta for another 30 years.

Column | Obama effigy draws ire in central Indiana town

LEBANON, Ind. (Indianapolis Star) -- I knew I was in the right place when I spotted the empty noose hanging from a gallows on the front lawn.

Inside the tiny turquoise house in Lebanon, I knew I'd find Eric Smith, the white guy with biracial kids who thought it was a good idea to hang an effigy of President Barack Obama from that noose for Halloween.

It was Thursday, the first day of November and the Halloween decorations were still up. I climbed out of my car, sized up the menacing-looking rope, and went to the door. Eric, an affable, blonde 30-year-old, opened it and I looked down at his shirt. "I'm not a bigot," it shouted in all capital letters. "I'm the first one to say it isn't your fault you're black."

I took a deep breath, willed away any judgmental thoughts and reminded myself why I drove all the way there in the first place.

Eric didn't know it, but I was looking for hope. Or maybe proof that people are more complicated in their views than 140-character tweets, Facebook memes and headlines give them credit for. I was looking for gray in an increasingly politicized world of black and white.

As we head into Election Day, signs abound that Americans are more divided than ever. A recent poll by the Associated Press found that more Americans have negative feelings toward blacks today than before Obama was elected. Anti-Hispanic sentiments aren't much better. And now, the devastation wrought by Hurricane Sandy in New York has highlighted the stark divisions between rich and poor when it comes to getting help.

Those things that divide us also have taken over our political discourse to our detriment.

Many Americans are in silos -- ready to assume and react, not question and learn. So, when you read about a guy in small-town Indiana who decides to put up an effigy of Obama on his front lawn, it's easy to think the worst.

I did. My first thought was: "Oh, great. Another racist idiot making headlines."

But then I read that Eric's longtime partner, Heather Wahls, is black and that they have three biracial children. I also read that he's a veteran who served in Iraq and that the American Civil Liberties Union has filed a lawsuit on his behalf because he was told he needed a permit to protest on Monument Circle. I thought: "Maybe this guy isn't who he seems to be."

He isn't. Eric is a complicated character.

Born in Noblesville, he and his four siblings were raised by a single mother who worked full time and went to school full time. His family ended up in Lebanon, where he met Heather at age 15. After high school, he used student loans to study law enforcement and then joined the Indiana National Guard. He was injured, however, and had to return to school to choose a new career, which, of all things, was social work.

Eric is a patriot to the core. He has, for example, taught his 10-year-old son to show respect by not moving or talking whenever the National Anthem is playing. He's a strong supporter of the Second Amendment and believes in entrepreneurship, not "penalizing the rich" with higher taxes.

But don't think he's a blind Mitt Romney supporter. "He just seems like a snake."

What's more, he acknowledges that Obama has done some good things. He dismisses the idea that the president is responsible for the country's economic mess, or the uptick in the number of people on public assistance.

"Sure, there's going to be more people on welfare because the economy tanked," Eric said. "It has nothing to do with Obama being like: 'Come on. Line up for food stamps.'"

Most of Eric's qualms with Obama have to do with foreign policy -- and that's why he put up the effigy. At first was tied on a fence closer to his family's house. He says he used the rope only to make sure it wouldn't blow away.

Then came the attention from passers-by. People started to throw objects at his house and call him a racist. Then the reporters arrived. Eric says he was shocked and so was Heather.

"We're not the kind of people who dwell on things," he said. "We don't dwell on whether racism still exists, so it wasn't a black and white thing to her. She knows I'm an attention-getter."

It was when Eric decided to push the envelope further that things got worse. Instead of taking the effigy off the fence, he hung it from a noose.

"You want to call me racist and you don't even know me? I'm going to show you. I'll make it real bad," he said to describe his thinking at the time.

Now, if all of this seems childish to you, I'd have to agree. Even Eric would agree. But that, he says, is his point: The fact that Americans are still divided over race is childish and unnecessary.

"I wasn't brought up that way, so I don't bring my kids up that way," Eric said. "We don't teach them that. We don't teach them that noose equals lynchings, that rainbows equal gay."

Now do I, as a black woman, think this is an oversimplification? Yes. I know racism still exists, and I don't think it helps to pretend it doesn't.

But, I also see where Eric is coming from. And I agree with him on the effect that this division has had on our government. It's more like distract, divide and conquer.

"All the politicians are pitting us against each other," he said. "We're supposed to be a country that's together. But we're not. Ever."

Like Eric, most people aren't all good or all bad, all Republican or all Democrat. People have their reasons why they believe what they believe, and I wish more people would ask and listen instead of tuning out and assuming. It's the only way we will learn to work together toward common goals.

As we go to the polls Tuesday and vote for candidates who have worked to portray their opponents as caricatures of black and white, let's try to see ourselves and others as complicated characters who live in the gray. We all have value, and something to contribute to our country.

Swing state voters tied ahead of election

WASHINGTON -- Voters in the nation's key battlegrounds have become as enthusiastic and engaged in the 2012 presidential election as they were in the historic contest four years ago, and they finally have made up their minds about President Obama and Mitt Romney.

It's a tie: 48%-48%.

The even split among likely voters in the USA TODAY/Gallup Poll of Swing States reflects gains in the campaign's final weeks by Obama, who has closed a 4-percentage-point deficit from early October in the wake of a disappointing first presidential debate. Most of the interviews were completed before Hurricane Sandy hit, and the president's disaster response may have bolstered his standing a bit since then.

The 11th and final Swing States Poll, a USA TODAY series that began a year ago, finds voters increasingly excited about the election and settled in their support. They say they have a clear idea what each candidate would do if elected - though that has caused some alarm. Most express concern that a President Romney would return to failed GOP policies and that a re-elected Obama would rely too much on Big Government.

As Election Day approaches, Obama leads 50%-46% among registered voters. That's the first time since Romney clinched the Republican nomination last spring that either candidate has reached the 50% threshold and the biggest margin during that time.

The poll was taken in the dozen battlegrounds most likely to determine the outcome in the Electoral College: Colorado, Florida, Iowa, Michigan, Nevada, New Hampshire, New Mexico, North Carolina, Ohio, Pennsylvania, Virginia and Wisconsin. In a sign of their importance, one or both of the presidential candidates held events during the campaign's final days in nine of those 12 states - and neither stumped anywhere else.

In polls of individual states, aggregated by RealClearPolitics.com, Obama has an edge in nine battlegrounds, including a narrow 2.8-point lead in crucial Ohio. Romney leads in two, Florida and North Carolina, and Virginia is essentially even. Combined national polls put Obama at 47.5%, Romney at 47.3%.

Senior strategists in both campaigns saw encouraging signs in the USA TODAY findings.

Jim Messina, Obama's campaign manager, said the president has gained momentum and now leads narrowly in statewide polls in most battlegrounds because a stark economic choice has "crystallized" for voters, especially in the three debates. "People understand that this president is on their side," he said in an interview. "People know he's going to fight for them every single day."

Neil Newhouse, Romney's pollster, notes the closeness of the contest. "The bottom line is, we're looking at this as a dead heat, a jump-ball kind of race that's tied right now, and we've got an intensity advantage. That kind of enthusiasm advantage translates into a turnout advantage on Election Day," he said in an interview. "The election now comes down to turnout, to intensity, to ground game."

Obama has improved his standing in the past few weeks by regaining support among women in the swing states. The gender gap - that is, the disparity between the way men and women vote - stands at historically high levels after narrowing in the early October. Obama now leads among women by 16 points; Romney leads among men by 10.

Romney leads among white men by a yawning 27 points; the two candidates divide white women evenly. The former Massachusetts governor leads among independent voters by a single point.

'Sending a message'

Allison Fitzwater, 42, of Viroqua, Wis., voted for Obama four years ago and, despite some disappointments, was determined to support him again from the opening days of the campaign. "I like the changes I've seen so far and I want them to continue," the high-school science teacher, who was among those polled, said in a follow-up interview.

Scott Cunningham, 28, a chemist from Sparks, Nev., decided in just the past week or two to cast his vote for Romney and against the president.

"It has everything to do with sending a message that, like any other job, if you get hired to do a four-year job or a six-month contract, if you're not doing a good job at the end of that period, you're going away," he said. "In the beginning (Obama's) message was, 'Give me a shot, coach; put me in; I can play.' Well, you got your chance. You can't say, 'I need a little more time.'"

Obama has lost some luster over the past four years - perhaps no surprise after a tenure launched during an economic crisis.

He won all 12 of the swing states in 2008, carrying 53.9% of their combined vote over Republican John McCain. This time, given the divide between solidly Republican and solidly Democratic states elsewhere, he needs to claim close to half of their 151 electoral votes to amass the 270-vote total that will give him four more years in the White House.

Registered voters are less likely to identify themselves as Democrats now than they were four years ago. In the Swing States survey, 37% call themselves Democrats, down 4 points from 2008; 29% call themselves Republicans, up 3 points. The percentage of independents is 34% now, 32% then.

At the end of the 2008 campaign, 63% of registered voters in the battlegrounds had a favorable impression of Obama; now 55% do. The percentage who see him as a strong leader has declined 11 points, to 53%. Those who say he understands the problems Americans face in their daily lives has dropped 14 points, to 60%.

Romney continues to hold an advantage on the economy, which Americans identify as the most important issue this year by far. Voters prefer him over Obama in handling the economy by 3 points and in handling the federal budget deficit by 10 points. The former Massachusetts governor is seen as a stronger leader and the candidate who could do a better job managing the federal government.

"I just feel like the economy will recover a bit faster if he were to become president," says Raymond Perez, 33, a registered nurse from Miami who plans to vote for the Republican.

In what is one of this year's enduring puzzles, however, Romney has struggled to pull decisively ahead with voters despite their preference for him on their most important issue - perhaps because he hasn't convinced many of them that he understands their lives and will protect their interests.

"He just doesn't really have a clue about how others live," Fitzwater says, mentioning the secretly recorded video in which Romney spoke dismissively of the 47% of Americans who don't pay federal income taxes. "He seems to think that people with money need to keep their money, while I see people with money having a responsibility to help those who aren't as well off as they are."

Obama is favored in handling everything except the economy and the deficit - on foreign affairs, national security, energy, health care and taxes. And the president continues to be viewed as more empathetic than Romney. Six in 10 say Obama "understands the problems Americans face in their daily lives." Just 45% say that of Romney.

How are you feeling?

A year ago, voters in the battlegrounds weren't particularly excited about this presidential race.

In the first Swing States Poll, in October 2011, fewer than half said they were enthusiastic about the election. That number rose only to 51% in late January, during the heat of the battle for the Republican nomination. That's 10 points lower than at that point in 2008, when there were nomination fights in both parties.

The percentage of voters who said they had given "quite a lot" of thought to the election was significantly lower at the beginning of the year as well.

Now, though, Americans are as engaged in the election as they were in the groundbreaking contest four years ago, which featured the first African-American candidate for president on the Democratic ticket and Sarah Palin for vice president on the GOP side. Eighty-six percent of registered voters say they have given quite a lot of thought to the election, just about the same percentage who said that at the end of the campaigns in 2008 and 2004. It's considerably higher than the number who felt that way in 2000 and 1996.

Increased voter interest generally could signal another high-turnout election.

The increase in enthusiasm is particularly pronounced among women, especially middle-aged and senior women. The proportion of women who say they are extremely enthusiastic has more than doubled in the past year; it's nearly tripled among those 50 and older.

Overall, Republicans continue to have an enthusiasm advantage, though it has narrowed in the past year. In October 2011, a third of Republican voters were extremely enthusiastic about the presidential election, more than double the number of Democrats who felt that way. Now, 51% of Republicans and 44% of Democrats say they're excited about it.

Ann Freund, 47, a homemaker from Hudson, Ohio, who supports Obama, acknowledges his campaign is less electrifying this time than it was four years ago.

"As a country, we've all been through some rough times, so it's hard to generate that same enthusiasm," she says. "It's like when you get married, and four years later, the stars aren't in your eyes anymore. You lost your job; you had a baby; you had to move across the country or whatever. You have those bumps in the road with your life together. And with President Obama, right off the bat we had tons of (trouble)."

When Romney clinched the Republican nomination last spring, there were a lot of undecided voters for the two candidates to battle for: Nearly a third said they hadn't made up their minds. Now, fewer than one in 10 say it's possible they'll change their minds. In fact, 22% already have cast ballots in early or absentee voting; they broke narrowly for Romney.

What has influenced voters' decisions?

More than six in 10 cite the debates, and half say editorials or commentary mattered. More than a third were affected by the political conventions. But to the skepticism of experts, voters downplayed the power of all those campaign ads. Fewer than one in four say the TV spots affected their vote.

"Seeing the debates kind of solidified my decision," says Lori Cook, 49, a human-resources manager from Roanoke, Va., who was among those surveyed. "After seeing the debates, I felt more comfortable with my decision." She is backing Romney, though she sounds less than thrilled by her options. "Well, there's only the two to choose from," she notes.

The Swing States Poll of 1,183 registered voters, including 1,077 likely voters, was taken Oct. 27-31 by landline and cellphone. The national survey of 1,447 registered voters was taken Nov. 1-2 for comparison purposes. Each has an error margin of +/-4 points. The head-to-head matchup is based on interviews with 2,192 registered voters and 1,984 likely voters in the Swing States Poll and the Gallup daily poll taken in those 12 states from Oct. 22-28. It has a margin of error of +/-3 points.

Swing states residents describe being deluged by campaign ads on TV and courted by campaign workers on the phone and at the front door. Freund has gotten robo-calls from Mitt Romney and from Ann Romney. Her 12-year-old son, Alex, managed to shake hands with former president Bill Clinton at a rally Thursday.

Fifty percent of voters in the battlegrounds say the Romney campaign has contacted them by e-mail, phone, mail or in person; 49% say they've heard from the Obama campaign. (In contrast, just a third of Americans nationwide say they've had personal contact from each of the campaigns.)

The impact of all that attention isn't always positive.

Carol Mack, 63, is principal of the Matthew Thorton Elementary School in Londonderry, N.H., where the students made voting booths from refrigerator boxes and held a mock election Friday.

"I noticed that the children were quoting sound bites from the commercials," Mack said with dismay. "One child says to me, 'You should vote for Romney; Obama is destroying the country!'"

Their ballots will be counted Monday.

A 'clear idea' - and some alarm

About two-thirds of registered voters say they have a clear idea of what each candidate would do in office over the next four years. That knowledge hasn't always eased their minds.

A 53% majority - including about one in four of his supporters - say they are concerned that Romney in office would adopt policies "that are too similar to what former president George W. Bush pursued."

And 64% of those surveyed - including almost four in 10 of his supporters - say they are concerned that a re-elected Obama would rely too much on the federal government to solve the country's problems.

In follow-up interviews, voters of all stripes express concerns about the direction of the country and the ability of Washington to fix the country's woes.

Judy Sessoms, 67, an Obama supporter from Bladen County, N.C., hopes there will be less of the sharp partisanship that has divided Washington. "I hope it'll change with the election," she says, but she worries it won't. "Some people seem to be very entrenched in their desire to just continue to say 'no'" to the other side, she says.

"This is just an incredibly crucial election," says Jeffrey Crum, 47, of State College, Pa. "I feel like there's more at stake this time than usual," agrees Cook, who supports Romney in part because he was able to work across party lines as governor of Democratic-dominated Massachusetts. "There's a lot of gridlock in Congress, and it's too bad that there can't be more partisan efforts made on a lot of things."

When voters in the swing states were asked in an open-ended question to describe the long campaign in a word or two, they divided about evenly between positive words ("intense," "good") and negative ones ("nasty," "lies").

The most frequent response was "interesting," and the second was "important."
